These Terms of Service (as amended from time to time, the “Terms”) govern your access to and use of Lucia Travel’s mobile application(s) (the “App”), our website located at luciatravel.ai (the "Site"), and any other products, applications, websites, or services that we own or control and that link to these Terms (collectively, the "Service"). By accessing, browsing, or otherwise using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you may not use the Service. If you use the Service on behalf of a company or other entity, you represent that you have authority to bind that entity, and “you” includes that entity.

We may change these Terms at any time. If we make changes, we will post the updated Terms and revise the “Date of Last Revision” above. If changes are material, we may provide additional notice through the Service, by email, or by other reasonable means. Your continued use of the Service after the effective date of updated Terms constitutes your acceptance of the updated Terms.
Your use of the Service is also subject to our Privacy Policy. By using the Service, you consent to our collection, use, and disclosure of information as described in the Privacy Policy.
By using the Service, you consent to receive communications from us electronically (for example, via email, in-app notices, or through the Site), including notices about your account, bookings, security, and changes to these Terms or our policies. You agree that electronic communications satisfy any legal requirement that such communications be in writing. You are responsible for keeping your email address up to date and for checking your inbox (including spam or junk folders).
The Service is intended only for individuals who are at least eighteen (18) years old (or the age of majority where you reside, whichever is higher). If you are under 18, you may not use the Service.
The Service is designed to be an AI-powered platform for travel planning and recommendations, and may support bookings of travel-related products and services through third parties. AI transparency disclosure: When you interact with the Service, you are interacting with an AI-driven conversational system and not a human operator. AI outputs may be inaccurate, incomplete, or outdated. You are responsible for verifying important information (including availability, prices, opening hours, safety advisories, and travel requirements) before making decisions.
Some features require you to create an account. If you create an account, you agree to provide accurate and complete information and to keep it up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us promptly of any unauthorized use of your account or any other breach of security.
We do not generally sell travel products or services directly. If you request a booking (e.g., tickets, accommodations, transportation, experiences), the booking is made with a third-party provider (each, a “Travel Provider”). We may (a) redirect you to a Travel Provider to complete a booking, or (b) collect information from you and transmit it to the Travel Provider to facilitate the booking, depending on the feature you use. Travel Providers’ terms and policies will govern your booking, including cancellations, changes, refunds, and fees. We are not responsible for the acts or omissions of Travel Providers, and we do not assume liability for bookings made with Travel Providers.
Site checkout. The Site may allow you to place orders and complete payments for certain Travel Provider offerings through embedded checkout flows. Unless explicitly stated otherwise at checkout, your booking contract is with the applicable Travel Provider (not Lucia Travel), and Lucia Travel acts as a facilitator. Travel Providers remain responsible for fulfilling the booked services. App experience. The App may provide travel planning and recommendations and may link you to Travel Providers to complete bookings. The App may not support in-app payment or checkout at this time.
Prices, availability, and other booking details are provided by Travel Providers and may change at any time. We do not guarantee that any listed price or availability will remain valid until the time you complete a booking.
If payment processing is available through the Site or other parts of the Service, payments will be processed by third-party payment processors such as PayPal (each, a “Payment Processor”). Payment Processors handle your payment information in accordance with their own terms and privacy policies. We do not store your full payment card details. Payment disputes. If you initiate a dispute, reversal, or chargeback with a Payment Processor, you agree to provide reasonable information and cooperation so that we and/or the Travel Provider can respond. The outcome of disputes may be governed by the Payment Processor’s rules and the Travel Provider’s policies. We may suspend or limit your account if you engage in excessive, abusive, or fraudulent disputes.
Cancellations, changes, and refunds are subject to the applicable Travel Provider’s policies and the rules and restrictions disclosed at the time of booking. We do not guarantee that a Travel Provider will honor any request. Where a booking is completed through the Service, we may provide tools to submit requests, but the Travel Provider’s decision controls.
The Service may let you share itineraries or plans via short links or email. You are responsible for:(a) ensuring you have the right to share the content;(b) not sharing sensitive personal information; and(c) understanding that anyone with access to a shared link or email may be able to view the shared content. We do not operate a public social network or community feature at this time. Sharing is intended for private sharing to people you choose.
We may modify, suspend, or discontinue all or part of the Service at any time, including adding or removing features. We will use commercially reasonable efforts to provide notice where feasible, but we are not obligated to do so. We are not liable for any modification, suspension, or discontinuance of the Service.
You are solely responsible for all content you submit to the Service, including messages, prompts, itineraries, images, or other materials (“User Content”). You agree not to use the Service to:
Violate any applicable law or regulation.
Infringe or misappropriate the intellectual property or other rights of others.
Upload or transmit malware or code intended to disrupt, damage, or interfere with the Service or others’ devices.
Engage in harassment, hate, threats, or unlawful, harmful, or abusive behavior.
Submit sensitive personal information that you are not authorized to share (e.g., others’ passports, IDs, financial account numbers).
Attempt to gain unauthorized access to the Service, accounts, or systems.
Scrape, data mine, reverse engineer, or extract data from the Service except as permitted by law or with our prior written consent.
Circumvent security measures or access restrictions where such circumvention is prohibited.
Use the Service to develop or improve competing products or services using our Service Content or confidential features.
We may suspend or terminate your access to the Service if we believe you have violated these Terms or if your use poses risk to the Service, users, or third parties.
The Service and its content, features, and functionality (including software, text, graphics, logos, and design) (“Service Content”) are owned by Lucia Travel or its licensors and are protected by intellectual property laws. Except as expressly permitted, you may not copy, modify, distribute, sell, lease, scrape, or create derivative works from the Service or Service Content.
You retain your rights in your User Content. You grant Lucia Travel a non-exclusive, worldwide, royalty-free, fully paid-up, transferable, sublicensable license to host, store, process, reproduce, modify (for technical purposes), display, and distribute your User Content as necessary to operate, maintain, and provide the Service and to provide features you request (including generating AI outputs).
If you provide suggestions, ideas, feedback, reviews, or other information (“Feedback”), you agree that we may use it without restriction or compensation to you.
We respect the intellectual property rights of others. If you believe that content on the Service infringes your copyright or other intellectual property rights, please send a notice to support@luciatravel.ai with sufficient information for us to investigate, including:
The Service may integrate with or link to third-party services, websites, tools, APIs, or resources (“Third-Party Services”). Your use of Third-Party Services is subject to the third party’s terms and privacy policy. We do not control and are not responsible for Third-Party Services.
You agree to use the Service in compliance with applicable laws and regulations. You may not use the Service in a way that would cause Lucia Travel or its service providers to violate applicable sanctions, export controls, or trade restrictions.
If you download the App from Apple’s App Store, you acknowledge that:
We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms, or if we discontinue the Service. You may stop using the Service at any time. Sections that by their nature should survive termination will survive, including intellectual property, disclaimers, limitation of liability, and dispute resolution.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. WE DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT AI OUTPUTS OR RESULTS WILL BE ACCURATE OR RELIABLE.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LUCIA TRAVEL AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING LOSS OF PROFITS, GOODWILL, USE, OR DATA, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO US (IF ANY) FOR THE SERVICE IN THE SIX (6) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR USD $100, WHICHEVER IS GREATER.
To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Lucia Travel and its affiliates and their respective officers, employees, directors, agents, and service providers from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any rights of another.
This section affects your rights. Please read it carefully. Governing law. Unless otherwise required by mandatory consumer protection laws, these Terms and any dispute arising out of or related to the Service will be governed by the laws of the People’s Republic of China (for this purpose, excluding Hong Kong SAR, Macau SAR, and Taiwan), without regard to conflict of law principles. Mandatory local rights. If you are a consumer and the laws of your country of residence provide you with mandatory rights or require disputes to be resolved in a particular forum, those mandatory provisions will apply to the extent they cannot be waived by contract. Informal resolution. Before initiating formal proceedings, you agree to contact us at support@luciatravel.ai and provide a description of the dispute. We will attempt to resolve the dispute informally. Courts. If the dispute is not resolved informally, and unless otherwise required by applicable law, you and Lucia Travel agree to submit the dispute to the courts with jurisdiction in Shanghai, China. Optional arbitration. If both you and Lucia Travel agree in writing, a dispute may instead be resolved by arbitration in Shanghai, China under the rules of a recognized arbitration institution.
Entire agreement. These Terms (together with policies incorporated by reference, including the Privacy Policy) constitute the entire agreement between you and Lucia Travel regarding your use of the Service. Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, sale of assets, or the corporate changes described in Section 1. Severability. If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. No waiver. Our failure to enforce any right or provision of these Terms will not operate as a waiver of that right or provision.
